DEM ANNOUNCES CONSENT AGREEMENT WITH MONIZ FAMILY; REMOVAL PLAN FOR CLAMSHELLS ACCEPTED

PROVIDENCE - The Department of Environmental Management announced today that John Moniz, Jr., his wife and sons have agreed to a removal plan for the clamshells on John Moniz' Tiverton farm, and have entered into a consent agreement with DEM and the state attorney general's office to remove the bulk of the clamshells and abate wetlands violations on the property within six months. The consent agreement was entered as a judgement in Providence Superior Court by Judge Rogeriee Thompson. As a result of the agreement, John Moniz Jr. was released from jail.

The consent agreement allows a small amount of clamshells to remain around the barn and outbuildings on the Moniz property to provide access for vehicles. The rest of the clamshells will be removed in stages under the removal plan, which has been incorporated into the consent judgement. The clamshells must either be disposed at a licensed solid waste management facility or put to a beneficial use if so approved by DEM. Odor control measures must be employed to prohibit objectionable odors beyond the Moniz property line.

Fines and penalties already accrued as a result of the solid waste and wetlands violations caused by the clamshells illegally stored on the property will be held in abeyance pending complete compliance with the consent judgement.
