NOTICE OF PUBLIC HEARING AND COMMENT PERIOD

Concerning Major Source Permit to Rhode Island Central Genco, LLC

The Office of Air Resources offers an opportunity for public comment regarding its proposal to issue a Major Source Permit to Rhode Island Central Genco, LLC. Rhode Island Central Genco, LLC has applied to increase allowable air pollution emissions from its facility by installing five, landfill gas-fired combustion turbines and three flares at its existing facility at 65 Shun Pike, Johnston, RI.

The existing facility consists of fifteen landfill gas fired engine-generator sets. The proposed project will add five combustion turbines also fired by landfill gas and eliminate eleven of the landfill gas fired engine-generator sets. The Office of Air Resources has determined that if the facility is constructed and operated in the manner described in the application, it will comply with applicable state and federal air pollution control rules and regulations. Therefore the Office of Air Resources is proposing to issue a Major Source Permit to Rhode Island Central Genco, LLC. The Office of Air Resources has prepared a draft permit for public review and comment.

The Office of Air Resources has reviewed Rhode Island Central Genco, LLC's application for a Major Source Permit. This application details the air quality modeling and other analyses performed, as well as the equipment and procedures proposed to be used to comply with applicable state and federal air pollution control rules and regulations. The Office of Air Resources has determined the proposed NOx and VOC emission rates for the combustion turbines and flares represent the Lowest Achievable Emission Rate (LAER). Rhode Island Central Genco, LLC has arranged to obtain the required 116 tons of NOx emission offsets and 36 tons of VOC emission offsets. Air quality modeling performed by the applicant demonstrated that the maximum predicted impacts from the proposed facility will not cause or contribute to air pollution in violation of the applicable National Ambient Air Quality Standards or in excess of the allowable PSD increments or in excess of Acceptable Ambient Levels for toxic air contaminants.

The draft Major Source Permit and supporting documentation may be viewed during normal business hours (8:30 AM to 4:00 PM) at the Office of Air Resources. For a copy of the draft Major Source Permit, a fact sheet further describing the project or for more information contact Douglas McVay at 401-222-2808. A copy of the draft Major Source Permit, the fact sheet further describing the project and the technical review document are also available for viewing or downloading on the DEM website (www.state.ri.us/dem).

The public comment period for this draft permit begins today and continues until 16 April 2009. A public hearing for interested persons to appear and submit written or oral comments on the draft permit will be held in Room 300 at the Rhode Island Department of Environmental Management's offices, 235 Promenade Street, Providence, Rhode Island on 16 April 2009 at 10:00 AM, at which time interested parties will be heard.

Written comments, to be considered part of the administrative record must be submitted during the public comment period. Written comments may be mailed or e-mailed to the Office of Air Resources and received no later than 4:00 PM, 16 April 2009, at which time the public comment period will close unless extended by the Hearing Officer.
