NOTICE OF PUBLIC HEARING AND COMMENT PERIOD

The Office of Air Resources offers an opportunity for public comment regarding its proposal to approve Ocean State Power’s (OSP) application for a minor modification to its current major source permit (RI-PSD-1) and its current operating permit (RI-15-06). The requested modification is to allow discretionary burning of low sulfur fuel oil at OSP’s electric power plant in Harrisville.

OSP's current permit limits fuel oil burning to that needed to maintain oil system readiness and times when natural gas is unavailable. Discretionary burning of fuel oil is not allowed. The maximum sulfur content of the fuel oil is currently limited to 3000 parts per million (ppm) by weight.

The proposed approval would allow OSP to burn fuel oil at their discretion during the period from 1 October to 30 April each year. The quantity of fuel oil burned would be limited to 4,539,000 gallons during any 12-month period. This would allow approximately six days of operation at the facility's maximum capacity. DEM would also limit the potential annual emission increase in nitrogen oxides emissions to 24 tons in any 12-month period. Under this proposal the sulfur content of the fuel oil burned would be limited to 15

Air quality dispersion modeling conducted in support of the application demonstrates that:
  1. The predicted air quality impacts of sulfur dioxide (annual impacts), carbon monoxide and particulate matter less than 10 microns in diameter, when burning fuel oil, are less than the significance levels in DEM’s Air Pollution Control Regulation No. 9; and,


  2. The predicted air quality impacts of sulfur dioxide (3-hr and 24-hr impacts) and nitrogen oxides, when burning fuel oil, when combined with a background concentration, are less than the National Ambient Air Quality Standards for these pollutants.
Continuous emission monitors would be used to measure emissions of nitrogen oxides to ensure that OSP is in compliance with the nitrogen oxides limitations.

The Office of Air Resources has reviewed OSP's application for a minor modification to its current permit. This application details the air quality modeling and other analyses performed, as well as the equipment and procedures proposed to be used to comply with applicable state and federal air pollution control rules and regulations. The Office of Air Resources has determined that if the facility is operated in the manner described in the application, it will comply with applicable state and federal air pollution control rules and regulations. Therefore the Office of Air Resources is proposing to approve OSP's application for a minor modification to its current permits. The Office of Air Resources has prepared draft permits for public review and comment.

The public comment period for these draft permits will begin today and continue until 25 January 2007. A public hearing for interested persons to appear and submit written or oral comments on the draft permits will be held in Room 300 at the Rhode Island Department of Environmental Management’s offices, 235 Promenade Street, Providence, RI on 25 January 2007 at 10:00 AM at which time interested parties will be heard.

Written comments, to be considered part of the administrative record, must be submitted during the public comment period. Written comments must be sent to the Office of Air Resources at the address below and received no later than 4:00 PM, 25 January 2007, at which time the public comment period will close unless extended by the Hearing Officer.
