NOTICE OF PROPOSED AMENDMENTS OF THE RULES AND REGULATIONS FOR COMPOSTING FACILITIES AND SOLID WASTE MANAGEMENT FACILITIES AND PUBLIC HEARING The Director of the Rhode Island Department of Environmental Management (DEM) proposes the amendment of "Rules and Regulations for Composting Facilities and Solid Waste Management Facilities, promulgated January 10, 1997" and amended April 17, 2001 and gives notice of intent to hold a public hearing on the proposed amendment, and gives notice of intent to receive public comment on the proposed amendment, and to afford interested parties an opportunity to submit data, views, or arguments, orally and/or in writing, on the proposed amendment in accordance with R.I.G.L Section 42-35-1 et seq. The public hearing will be held at 1:30 PM on Thursday, November 8, 2007 in Room 300 of the DEM Offices at 235 Promenade Street, Providence, RI 02908. The proposed amendments are to Solid Waste Regulation No. 1 - General Requirements, Solid Waste Regulation No. 3 - Transfer Stations and Collection Stations, and Solid Waste Regulation No. 7 - Facilities That Process Construction and Demolition Debris for the purpose of clarifying the regulation of construction and demolition debris. A copy of the proposed regulations can be accessed at the DEM website, http://www.dem.ri.gov. (Click on Publications/Regulations and go to the Proposed Regulations section). Copies will also be available for those that do not have website access in DEM's Office of Technical and Customer Assistance and at the public hearing. Any additional requests can be made by contacting DEM at 222-2797 weekdays, 8:30 AM- 4:00 PM. DEM has complied with the requirements of R.I. General Laws Section 42-35-3 by considering alternative approaches to the proposed amendment of regulations and has determined that there is no alternative approach that would be as effective and less burdensome. DEM has also determined that the proposed amended regulations do not overlap or duplicate any other state regulation or statutory provisions nor will they result in significant adverse economic impact on small businesses. DEM has complied with the requirements of R.I. General Laws Section 42-35-3.3 by submitting copies of the proposed amended regulations to the Governor's Office and the Economic Development Corporation (EDC). The DEM encourages the submission of written comments prior to the date of the public hearing and at the hearing. All written comments should be sent to the DEM Office of Waste Management, 235 Promenade Street, Providence, RI 02908. The DEM will provide interpreter services for the hearing impaired, provided such a request is made at least 48 hours prior to the hearing date.
