PUBLIC NOTICE OF JOINT PUBLIC HEARING
NOTICE OF PUBLIC HEARING:
AMENDMENTS TO THE
RULES AND REGULATIONS FOR THE PRIORITY DETERMINATION SYSTEM
FOR FEDERAL AND STATE ASSISTANCE TO LOCAL GOVENMENTAL UNITS
FOR CONSTRUCTION OF WATER POLLUTION ABATEMENT PROJECTS



The Director of the Rhode Island Department of Environmental Management ("DEM") proposes amendments to the Rules and Regulations for the Priority Determination System for Federal and State Assistance to Local Governmental Units for Construction of Water Pollution Abatement Projects. The proposed amendments have been drafted in order to update the project rating criteria.

Notice is hereby given of the intent to hold a public hearing on the proposed amendments to afford interested parties an opportunity to submit data, views, or arguments orally and/or in writing on the proposed amendments. The Department encourages submission of written comments prior to the date of the public hearing. All written comments should be sent to the Department at the address below.

The Department of Environmental Management has determined that the proposed amendments do not overlap or duplicate other regulatory or statutory provisions, nor do they have the potential for adverse economic impact on small businesses and cities and towns of the State.

The public hearing will be held on Monday, June 16, 2008 at 9:30 am in Room 200C1 of the Department of Environmental Management Offices, 235 Promenade Street, Providence, Rhode Island. A record of the hearing will be made. The hearing room is accessible to the handicapped. The DEM will provide interpreter services for the hearing impaired, provided such a request is made at least 48 hours prior to the hearing date. A request for this service can be made in writing to the Department or by calling (401) 222-6800 or TDD (401) 831-5508.

The Department has complied with the requirements of the RI General Laws Section 42-35-3 by considering alternative approached to the proposed amendments, and has determined that there is no alternative approach among the alternatives considered which would be as effective and less burdensome. The Department has determined that the proposed amendments do not overlap or duplicate any other state regulations, and has complied with the requirements of RI General Laws Section 42-35-3.3 by submitting copies of the proposed amendments to the Governor's Office and the Economic Development Corporation.
